1. DEFINITIONS
(a) Company refers to Atlantis TV Pty Ltd, including any related body corporate or associated entity.
(b) Customer refers to the person or entity hiring/purchasing the Equipment from the Company, including any representative or authorised agent.
(c) Equipment includes all items listed in the hire agreement or invoice, including but not limited to cameras, lighting, sound gear, and other video production equipment.
(d) Hire Charge refers to the cost of hiring the Equipment as specified in the agreement, including applicable taxes and fees.
(e) Purchase Price refers to the cost of purchasing the Equipment as specified in the invoice.
(f) Term refers to the agreed period of hire as specified in the agreement or invoice.
2. TERMS AND CONDITIONS
The Equipment is hired or sold under the terms outlined in this agreement. Modifications to these terms are only valid if expressly agreed in writing by Atlantis TV Pty Ltd.
3. HIRE OF EQUIPMENT
The Customer agrees to pay the full Hire Charge before the Equipment is removed from Atlantis TV Pty Ltd's premises unless prior credit arrangements are approved. In the event of cancellation, a fee of up to 50% of the Hire Charge may be applied if cancellation occurs less than 48 hours before collection.
4. SALE OF EQUIPMENT
(a) All sales are final, and the Purchase Price must be paid in full before Equipment is collected.
(b) Defective Equipment must be reported within 7 days of receipt.
(c) Partial delivery may occur; Atlantis TV Pty Ltd is not liable for delays in delivery.
5. CUSTOMER OBLIGATIONS
(a) The Customer must maintain the Equipment in good working order and protect it from damage.
(b) Equipment may not be taken outside Australia without written consent.
(c) The Customer is liable for any damage, theft, or loss of Equipment.
(d) The Equipment must not be repaired or modified without written consent from Atlantis TV Pty Ltd.
6. TITLE AND OWNERSHIP
(a) Title to the Equipment remains with Atlantis TV Pty Ltd during the hire period.
(b) The Customer must not sell, lease, or mortgage the Equipment.
(c) If payment is not received, Atlantis TV Pty Ltd reserves the right to reclaim the Equipment.
7. INSURANCE AND LIABILITY
(a) The Customer is responsible for insuring the Equipment during the hire period.
(b) Any loss, theft, or damage must be reported to Atlantis TV Pty Ltd immediately.
(c) The Customer is liable for the full cost of repair or replacement of damaged or lost Equipment.
8. WARRANTY AND EXCLUSION OF LIABILITY
Atlantis TV Pty Ltd provides the Equipment as-is and is not liable for indirect or consequential damages arising from the use of the Equipment.
9. GOVERNING LAW
This agreement is governed by the laws of Victoria, Australia. Any disputes shall be resolved in the jurisdiction of Victoria.
10. ACCEPTANCE
By signing this agreement, the Customer acknowledges understanding and acceptance of the terms and conditions outlined herein.
